1. Cure Cancer Australia Foundation is the owner and operator of this Site.
2. Users of this Site (Users) agree to be bound by these Terms & Conditions, which are subject to change at Cure Cancer Australia Foundation’s sole discretion. Your use of and access to this Site indicates your acceptance of these Terms & Conditions, as they exist at that time.

3. All intellectual property in relation to content on this Site belongs to Cure Cancer Australia Foundation. You obtain no interest in that intellectual property. Liability & Indemnity
6. Cure Cancer Australia does not warrant the accuracy of the content on the Site. All content on the Site may be changed at Cure Cancer Australia’s sole discretion and without notice.
7. Cure Cancer Australia Foundation will have no responsibility or liability in relation to any loss or damage that you incur, including damage to your software or hardware, arising from your use of or access to this Site.

Liability of Cure Cancer Australia Foundation, for any breach of a term or condition implied by law is limited at Cure Cancer Australia Foundation’s discretion, to the supply of any service again or the payment for the cost of having any service supplied again.
10. You indemnify Cure Cancer Australia Foundation and each of their directors, officers, employees and agents against any action, claim, loss or expense which it incurs which arises from your use of the Site.

Contributing Content
13. When you submit content to Cure Cancer Australia in any format, including any text, photographs, graphics, logos you grant Cure Cancer Australia Foundation a non-exclusive, royalty-free, perpetual license to publish that content.
14. You agree that Cure Cancer Australia Foundation can use that content in any way, now and in the future. Cure Cancer Australia Foundation also reserves the right not to use the content you submit.
15. You warrant that you have all of the necessary rights, including copyright, in the content you contribute, that your content is not defamatory and that it does not infringe any law.
16. You indemnify Cure Cancer Australia Foundation against any and all legal fees, damages and other expenses that may be incurred by Cure Cancer Australia Foundation as a result of a breach of the above warranty.
17. You waive any moral rights in your contribution for the purposes of its submission to and publication on the Site.
General
18. These Terms & Condition shall be governed by and interpreted in accordance with the laws of New South Wales.
19. Users will not use this site for any purpose or in any way which is unlawful.
Confirmation of Order
20. All orders placed are an offer of purchase and are subject to acceptance by Cure Cancer Australia Foundation. If an order is not accepted a full refund will occur at the earliest possible convenience. Cure Cancer Australia Foundation reserves the right to refuse an offer for any reason.
Payment
21. Cure Cancer Australia Foundation is under no obligation to deliver any goods ordered until payment for those goods has been received. In the case of payment by direct deposit, this would mean the clearing of funds being transferred. In the event of the requested goods being unavailable Cure Cancer Australia Foundation may cancel the transaction and effect a full refund. All prices listed are exclusive of Australian Goods and Services Tax. There is no GST applicable on the purchase of cards.
